Your brand name is one of your most valuable business assets. It is how customers find you, how they recognise you, and how you stand apart from competitors. Yet thousands of Indian businesses from solo entrepreneurs to fast-growing startups operate for years without legally protecting their brand name.
Trademark registration is the legal mechanism that protects your brand. Without it, anyone can use your name, logo, or tagline and you will have limited legal recourse. With it, your brand is protected under Indian law and you have the exclusive right to use it commercially.
A trademark is any sign a word, logo, symbol, phrase, colour, shape, or combination that distinguishes your goods or services from those of others. Common examples include your company name, product name, logo, a unique tagline, or a distinctive packaging design. Once registered, the TM symbol can be used while the application is pending, and the R symbol is used after registration is granted.
Before applying, search the Trademark Registry's public database at ipindiaonline.gov.in. Look for existing marks that are identical or confusingly similar to yours in the same class including exact word matches, phonetically similar names, visually similar logos, and marks with similar meaning.
The Indian Trademark Registry uses the Nice Classification with 45 classes Classes 1 to 34 for goods and 35 to 45 for services. Examples:
For individuals and sole proprietors: identity proof (Aadhaar or PAN), address proof, soft copy of the trademark, signed Power of Attorney (Form TM-M) if using an agent. For companies and LLPs: Certificate of Incorporation, company PAN, address proof, Board Resolution, and signed Power of Attorney.
You can file online at ipindiaonline.gov.in using Form TM-A (e-filing gives instant acknowledgement and lower fees) or offline at the nearest Trademark Registry office.
Government Filing Fees (2025): Individuals and startups: Rs. 4,500 per class (online). Companies: Rs. 9,000 per class (online).
Once filed, the application is assigned to an examiner who checks distinctiveness, conflicts with existing marks, and legal compliance. This typically takes 3 to 6 months. If objections are raised, you must respond within 30 days.
If accepted, the application is published in the official Trade Marks Journal for 4 months. Any third party can file opposition (Form TM-O) during this window. If no opposition is filed or opposition is resolved in your favour the mark proceeds to registration.
Once all stages are cleared, the Trademark Registry issues a Registration Certificate. Your mark is now officially protected for 10 years from the date of filing and can be renewed indefinitely.
Trademark registration is one of the most important legal steps any serious business should take. The process is accessible, the fees are reasonable, and the protection is lifelong. Don't wait until someone copies your brand name to start thinking about this. AU current accounts support businesses that are serious about growth from your first trademark filing to your hundredth business milestone.
The total trademark registration process in India typically takes 18 to 24 months if there are no objections or oppositions. However, once you file the application, you receive an acknowledgement and can begin using the TM symbol immediately. If the registry raises no objections, the process may be completed in 12 to 18 months.
Yes. You can use the TM symbol as soon as you file your trademark application in India. This signals that you have applied for registration and have a claim to the mark. The R symbol (in a circle) can only be used after the trademark is officially registered.
If the Trademark Registry raises an objection, you have 30 days to file a counter-statement. If you miss this deadline, the application is deemed abandoned. If you respond and the examiner is still not satisfied, you can request a hearing. If the mark is refused after the hearing, you can appeal to the Intellectual Property Appellate Board (IPAB) or a High Court.
Yes, you can file a trademark application yourself it is a government portal process. However, hiring a trademark attorney or agent is strongly recommended, especially for first-time applicants. Attorneys can help conduct a thorough trademark search, choose the right class, draft a strong application, and handle any objections or oppositions that arise.
A registered trademark in India is valid for 10 years from the date of filing. It can be renewed indefinitely for additional 10-year periods by filing a renewal application (Form TM-R) before the expiry date. A grace period of 6 months is available for delayed renewal, subject to a surcharge.
Two businesses can have the same trademark if they are in completely different classes of goods or services and the marks are unlikely to cause confusion among consumers. However, for well-known or famous marks, broader protection applies across all classes. Always conduct a thorough search before filing.
